Rep. Niemerg Says Fight Continues Against Illinois “Gun Ban” After Circuit Court Ruling

State Representative Adam Niemerg (R-Dieterich) responded to the 2-1 split decision by a three-judge panel of the 7th U.S. Circuit Court of Appeals to reverse a lower-court injunction imposed against the firearms restrictions in one set of cases. Several opponents to this gun ban, including Rep. Niemerg, have challenged the measure on grounds that it violates the U.S. Constitution’s Second Amendment right for individuals to “keep and bear arms.”

“It is my hope this will be appealed to the federal supreme court where we will have a different outcome. I will continue to fight for and with law-abiding citizens and gun shop owners to preserve our Constitutional freedoms in Illinois,” declared Rep. Adam Niemerg.

Rep. Niemerg points out that the appellate panel cited a U.S. Supreme Court opinion last year that struck down New York state’s limits on carrying concealed handguns outside the home.

“I am encouraged by the U. S. Supreme Court’s decision last year that established a new legal test for gun restrictions. Upon appeal, this law should fall under the same umbrella of constitutional protection,” added Rep. Niemerg.
